{"id":4803,"date":"2020-07-28T16:06:56","date_gmt":"2020-07-28T15:06:56","guid":{"rendered":"http:\/\/mouillere.com\/universconvergents\/?p=4803"},"modified":"2020-07-28T16:18:50","modified_gmt":"2020-07-28T15:18:50","slug":"plan-de-controle-de-lactivite-partielle","status":"publish","type":"post","link":"https:\/\/mouillere.com\/universconvergents\/2020\/07\/28\/plan-de-controle-de-lactivite-partielle\/","title":{"rendered":"Plan de contr\u00f4le de l\u2019activit\u00e9 partielle"},"content":{"rendered":"<p>Ma\u00eetre Fr\u00e9d\u00e9ric Chhum, toujours tr\u00e8s actif sur le <a href=\"https:\/\/www.village-justice.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Village de la Justice<\/a>, consacre un article complet sur les proc\u00e9dures de contr\u00f4le a posteriori et de sanction de la fraude au dispositif d\u00e9claratif d\u2019activit\u00e9 partielle.<\/p>\n<p><!--more--><\/p>\n<p>Les <strong>fraudes<\/strong> vis\u00e9es par les contr\u00f4les sont notamment :<\/p>\n<ol>\n<li>les cas de <strong>t\u00e9l\u00e9travail<\/strong> o\u00f9 un salari\u00e9 plac\u00e9 totalement activit\u00e9 partielle continue de travailler en t\u00e9l\u00e9travail, ou un salari\u00e9 \u00e0 temps partiel travaille en r\u00e9alit\u00e9 \u00e0 temps plein;<\/li>\n<li>le <strong>salari\u00e9 fictif;<\/strong><\/li>\n<li>le recours \u00e0 <strong>l&#8217;int\u00e9rim<\/strong> pour pallier aux salari\u00e9s plac\u00e9s en activit\u00e9 partielle afin de continuer l\u2019activit\u00e9 normale de l\u2019entreprise;<\/li>\n<li>la d\u00e9claration d\u2019activit\u00e9 partielle d\u2019un salari\u00e9 en <strong>cong\u00e9<\/strong> ou en arr\u00eat maladie;<\/li>\n<li>la<strong> d\u00e9claration de plus d\u2019heures en activit\u00e9 partielle <\/strong>que les heures effectives;<\/li>\n<li>la <strong>d\u00e9claration de taux horaires sup\u00e9rieurs<\/strong> \u00e0 la r\u00e9alit\u00e9 pour b\u00e9n\u00e9ficier de remboursement major\u00e9es par rapport au montant des salaires effectivement pay\u00e9s;<\/li>\n<li>le <strong>red\u00e9ploiement<\/strong> \u00e0 d\u2019autres t\u00e2ches de salari\u00e9s qui reste donc \u00e0 la disposition de leur employeur qui ne peut alors pas demander \u00e0 b\u00e9n\u00e9ficier de l\u2019allocation d\u2019activit\u00e9 partielle.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Les <strong>DIRECCTE<\/strong> (Directions R\u00e9gionales des Entreprises, de la Concurrence, de la Consommation, du Travail et de l\u2019Emploi) ou DIECCTE en Outre-mer sont charg\u00e9es des contr\u00f4les sur pi\u00e8ces ou sur place de mani\u00e8re al\u00e9atoire ou sur signalement par le biais de croisement de donn\u00e9es en mobilisant les agents de plusieurs organismes (inspecteurs du travail, inspecteurs URSSAF, etc.).<\/p>\n<p>Les agents peuvent solliciter tout document justifiant une diminution ou un arr\u00eat du temps de travail (plannings des salari\u00e9s, garde des enfants, vuln\u00e9rabilit\u00e9 face au Covid-19, etc.) et le taux horaire sur la base duquel la demande d\u2019indemnisation a \u00e9t\u00e9 effectu\u00e9e (bulletins de paie, contrats de travail, accords d\u2019entreprise, etc.),<\/p>\n<p>&nbsp;<\/p>\n<p>Ind\u00e9pendamment du dispositif de r\u00e9gularisation des entreprises de bonne foi, les sanctions \u00e0 la fraude pourront \u00eatre notamment :<\/p>\n<ol>\n<li>le remboursement par l\u2019employeur des aides accord\u00e9es et l&#8217;exclusion pour une p\u00e9riode maximale de 5 ans de l\u2019acc\u00e8s \u00e0 certaines aides publiques (<strong>fraude \u00e0 l&#8217;activit\u00e9 partielle constat\u00e9e par PV<\/strong>);<\/li>\n<li>150 000\u20ac d&#8217;amende (<strong>fausse d\u00e9claration)<\/strong>;<\/li>\n<li>375 000\u20ac et risque d&#8217;exclusion des march\u00e9s publics pour une dur\u00e9e maximale de 5 ans (<strong>travail ill\u00e9gal<\/strong>);<\/li>\n<li>7 ans d\u2019emprisonnement et 750 000\u20ac d\u2019amende quand l\u2019infraction est commise au pr\u00e9judice d\u2019une personne publique (<strong>Escroquerie<\/strong>).<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<iframe src=\"\/\/docs.google.com\/viewer?url=https%3A%2F%2Fmouillere.com%2Funiversconvergents%2Fwp-content%2Fuploads%2F2020%2F07%2Finstruction_aux_direccte_5_mai_2020_deploiement_du_controle_a_posteriori_sur_lactivite_partielle.pdf&hl=fr&embedded=true\" class=\"gde-frame\" style=\"width:100%;
